Clickbooth isn’t done yet…

Alright, I’m tired of these Clickbooth posts just as much as you, but I am pretty empty on ideas right now and clogged up with client work and school. So, one of their reps contacted me on MSN to support their (allegedly) disintegrating image. There is good news from it though. That email was not a C&D letter, so I don’t have to worry about getting sued just yet. Yay! Anyways, here is what they had to say:

Justin - Freelance Content Publisher for Hire says:
Whos this?
Ziare says:
Hi Justin this is Ziare with clickbooth
Ziare says:
how are you
Justin - Freelance Content Publisher for Hire says:
Fine.
Ziare says:
I wanted to reach out to you about some of your blogs regarding clickbooth
Justin - Freelance Content Publisher for Hire says:
I figured so.
Ziare says:
We just wanted to have a chance to discuss the situation
Ziare says:
and clear up any misconceptions
Justin - Freelance Content Publisher for Hire says:
Ok.
Ziare says:
do you have a few moments?
Justin - Freelance Content Publisher for Hire says:
Yup.
Ziare says:
the email you received from us was not a C&D, just wanted to clear that up
Justin - Freelance Content Publisher for Hire says:
Okay.
Ziare says:
C&D’s only come from our lawyers
Ziare says:
but we still wanted to reach out and defend our reputation
Justin - Freelance Content Publisher for Hire says:
I think it might be a tad to late for that.
Ziare says:
why is that?
Justin - Freelance Content Publisher for Hire says:
It is ruined amongst the community. Not just an individual.
Ziare says:
thats not true
Justin - Freelance Content Publisher for Hire says:
Alright.
Justin - Freelance Content Publisher for Hire says:
So what is true? I am assuming most of the Wicked Fire members, as well as Jon, aren’t? Correct?
Ziare says:
well the allegations that we dont pay our publishers are false
Justin - Freelance Content Publisher for Hire says:
Of course.
Justin - Freelance Content Publisher for Hire says:
So they are lying?
Ziare says:
they are definitely mistaken
Justin - Freelance Content Publisher for Hire says:
Alright.
Ziare says:
how is thailand btw, I had a chance to visit bangkok a couple years ago
Justin - Freelance Content Publisher for Hire says:
Fine.

Yeah, I admit I was a bit cold with them. What do you expect, though.

Who likes the new theme? I’m trying to clean it up a little here and there, so expect a lot of changes.

Why Shouldn’t You Blog?

If you are afraid of getting a little (bad) attention, stop blogging.

This whole C&D thing with me (as well as a few others) and Clickbooth has gotten ridiculous. I’ve been having a lot of trouble sleeping because of the email they’ve sent me. Can this be taken as the real deal? Will I get my butt sued off? Does it matter?

I don’t really know.

Is it worth it to go through what could be possible trouble for me? I could be facing a case against a company with millions of dollars to it’s name. What have I got? 200 in my pocket, and that’s for rent. Obviously, it would be mindless to keep the post up if these guys at Clickbooth are serious. Do I think they are serious? Yes, I do.  So why is the post still up?

I don’t really know.

I guess it is a pride thing. The freedom of speech, the freedom of communication, and the freedom of press (no matter what form it is in) are all things an American is born with. I’ve never been an outspoken person. I’ve kept quiet about a lot of crap in my life. I’ve backed down from a lot of that crap. Now isn’t the time to do it. I haven’t been sued, yet.

I’m sure if the threats increase, I will have to take them down. If I get a “real” C&D note from a lawyer, it will be removed. Getting an email from relations just isn’t going to cut it. Relations has absolutely no power in the law besides telling me to stop blogging falsities. Alright, sure. You got it Clickbooth. But I never told one lie in that post. I just informed what I allegedly knew about the alleged situation, and what everyone is allegedly saying you are allegedly up to… allegedly they say.

If you are going to bully someone around, bring in the big dogs the first time. This is absolutely ridiculous, Clickbooth. I don’t want to be sued, and you putting your money into suing me or any other little time blogger probably isn’t worth the lawyer fees you would undergo doing so.

Instead of suing us, why don’t you ask us what would make us take the posts down? How can you get on our good sides? How can you befriend Jon and the other Wickedfire members? How can you gain back the trust of a whole lot of affiliate marketers? How can you get your ads back in that marketing magazine?  Attacking us (allegedly) hasn’t seemed to have been of much help. And allegedly, it could mean the end of Clickbooth… allegedly. Thats my opinion at least, given to me by the 1st Amendment, thank you very much.

So, yeah, I should take the post down, just to save myself what allegedly…….. might be a lot of trouble. I don’t think I will though. Maybe I am just lazy, which I really am. Or maybe I just want to let others know what is going on with me and Blogosis. Because this domain is my property. What goes on my domain stays mine. It doesn’t all have to be valid fact, but I don’t go around pushing lies that can get me sued.

John Lemp, please, if you are still emotionally distressed from my posts, let me know. I know it must be tough for you. All that money in your pockets must not be enough (opinion/guess of mine… I’m not saying that could be false. Perhaps it isn’t enough. I don’t know). You don’t have to sue me to get emotionally stable. Write me personally, hell… call me!! (country exit code (I think it is 001 for the USA)) - 66 - 08 - 5617 - 0895. I will take all these posts down in an instant if you can prove to me it is hurting you. That’s no problem. Ask for Justin, and be aware I might answer in Thai (Hul - lo = Hello (Haha)). Alrighty?

I want to be cool with you Clickbooth. I want it honestly. I need to join some affiliate programs now that I got some shiny new credit cards. Its time for some extra revenue, you know? There is so much that could happen here, but I think you are just taking it all in the wrong direction. Maybe I am wrong though.

I really don’t know.

Clickbooth Email

Okay, there are a lot of these going around. Lot’s of guys on the Wickedfire.com boards are getting these.

A note to Clickbooth - You know I could never afford a lawyer of any kind. And you know what I did was harmless journaling (albeit hurting your reputation, it hasn’t exactly been above the water for any time recently. What I posted in my earlier posts were my righteous opinions that I am entitled to, not only by American law, but by Thai law, as well. What I will post in this post is again, my opinion. The fact that you are chasing after 20 year-old college students living off of student loans is absolutely ridiculous. You can’t catch the big fish, so you fry the little ones that have absolutely no association to you? Great marketing plan if you ask me. At least it has gotten your name out. Before the post on Wickedfire, I hadn’t heard of Clickbooth. Now, I know and I am plenty glad to inform others of sources from my research that says you guys are (or so my research says, not my known facts, just my research and in my 1st amendment given opinion which I cannot be sued for) fraudulent. If you want to prove this false, then step up. Pay all those affiliates that you (apparently) haven’t paid, apologize to Jon and wickedfire members that (it seems that) you (may have, or might not have) pissed off.

If you want the posts removed, please send me a notarized C&D note that says Cease and Desist somewhere on it so I know its the real deal. Okay and thanks.

Anyways, here is the email I got.

Good afternoon,

Clickbooth.com. It was posted March 9, 2008.

The aforementioned post’s content contains defamatory statements referencing Clickbooth and its owner, John Lemp. The information throughout the post is considered libelous, and legal action has already been taken against another such individual publishing similar statements.

We consider libelous and defamatory statements to be an extremely serious violation as they harm the Clickbooth brand, John Lemp, and all Clickbooth advertisers and publishers. We must take all the necessary steps to protect not only ourselves, but also our partners against such fallacious statements and misrepresentations which have been made to intentionally harm the goodwill of our company and the character of Mr. Lemp.

Clickbooth greatly appreciates its relationships with publishers and advertisers, and we fully stand behind the quality our network has to offer. We care about our reputation within the industry and wish to do all that we can to protect it. We are a long-term organization that strives to make partners happy and keep them that way. We couldn’t remain as successful as we have otherwise.

We wanted to touch base with you and express our concern regarding these comments. We are asking that you please remove the post in question. We are also certainly more than willing to work with you in order to help you better understand the issues at hand.

Please let us know your thoughts and how you intend to proceed regarding this post. We look forward to hearing from you.

Yeah, thats the email. Here is what I sent them.

Dear “Clickbooth Relations”,

I was just reporting what I heard about the story. Because I have not done anything wrong in journaling what others have said and what I’ve heard about Clickbooth as well as adding an opinion of my own. Unless you can tell me exactly what loopholes you are going to string through the 1st amendment, I will leave the post as is, and probably add this email copy to my blog.

Bullying may have worked in middle school, but this is the real world.

I look forward to not getting any more emails from you.

Justin

Yeah. I wasn’t too happy when I got the email. I’m sure that hurts me, but what can you do. If they are going to sue me, I’m probably screwed for life if Clickbooth can get away with it. Mr. Lemp would need some very, very expensive lawyers to argue the 1st amendment though. Here are some more places to chec out for more info on all this.

And there are some in the comments of the older posts that are track backs.

Looks like I might be in trouble.

Remember that post on Clickbooth I did about a week ago? Clickbooth read it. Hehe. Looks like they might want to take legal action against me. I got an email that could be considered possibly threatening from their relations department. While I am not sure how far this will actually go, I won’t say too much now. I know this is a bad update, but once I am sure I can’t be sued, you will get an update.

WickedFire.com is Getting Sued

I’m sure most of my readers around here are Digital Point users, and if you are not, it isn’t a bad spot to start looking for ways to get traffic to a blog or get into affiliate marketing. However, if you are really serious about this kind of stuff, you might want to look into Wicked Fire. Its like the vulgar brother of Digital Point. You gotta be not stupid to post on there, otherwise they will eat you up and spit you out. Ya’ hear?

Any who, if any of you are familiar with ClickBooth, you will know its an affiliate marketing CPA program, alike NeverBlueAds, Azoogle, and Clickbank. The unique think about ClickBooth though is  ‘a lot of people apparently’ hate them. They have ‘apperently’ been notorious for canceling campaigns, not paying out, and random bans from their program. This has gotten a lot of hate from a lot of people. Jon from WickedFire was one such member of John Lemp’s, the CEO of ClickBooth, hating fanclub.

He posted a lot of things that probably hurt his company on the forums. Freedom of speech comes into play here. However, John Lemp has turned the tables saying these things are slanderous and false. Jon, is laughing his head off at this, as he is not the only one onto Mr. Lemp’s ‘probable’ crap. In the end, here is what John Lemp at ClickBooth is suing for:

“Emotional Distress.”

I guess big boy Lemp is a little baby now. Words on the internet got him all teary-eyed so now he ‘apperently’ has to sue over it.

I mentioned the guys at WickedFire.com are harsh. Go read this thread. I don’t care if you have to make an account to look at it, just do it. It is worth your time just for the amazing content on the forum, not just this thread.

Anyways, make sure you check out the Wikipedia pages in the thread. They were live, but have been taken down now. The rips on Lemp and his name are killer (to me at least), as well.
This will be a pretty funny fight to watch.
